{"id":10132,"date":"2011-07-01T02:56:11","date_gmt":"2011-07-01T07:56:11","guid":{"rendered":"https:\/\/thevwindependent.com\/?p=10132"},"modified":"2011-07-01T10:07:15","modified_gmt":"2011-07-01T15:07:15","slug":"darst-gets-prison-for-injuring-baby","status":"publish","type":"post","link":"https:\/\/thevwindependent.com\/news\/2011\/07\/01\/darst-gets-prison-for-injuring-baby\/","title":{"rendered":"Darst gets prison for injuring baby"},"content":{"rendered":"<p><strong>DAVE MOSIER\/<\/strong><em>independent editor<\/em><\/p>\n<p>A Van Wert man convicted of seriously injuring his 9-week-old son was given a two-year prison term during a hearing Thursday in Van Wert County Common Pleas Court.<\/p>\n<p>Judge Sumner E. Walters, who heard the case on assignment from the Ohio Supreme Court, gave David Darst, 36, the minimum sentence allowable for a charge of endangering children, a second-degree felony offense. Second-degree felonies carry a maximum sentence of eight years. Judge Walters also gave Darst credit for three days already served while awaiting sentencing.<\/p>\n<figure id=\"attachment_10133\" aria-describedby=\"caption-attachment-10133\" style=\"width: 240px\" class=\"wp-caption alignright\"><img fetchpriority=\"high\" decoding=\"async\" class=\"size-full wp-image-10133  \" style=\"border: 1px solid black\" src=\"https:\/\/www.thevwindependent.com\/news\/wp-content\/uploads\/2011\/07\/Darst-file-photo-6-1-11.jpg\" alt=\"\" width=\"240\" height=\"359\" \/><figcaption id=\"caption-attachment-10133\" class=\"wp-caption-text\">David Darst listens to final arguments during his second jury trial in June. (VW independent file photo)<\/figcaption><\/figure>\n<p>Prior to sentencing, defense attorney Scott Gordon indicated that his client has \u201cgone through hell\u201d with the loss of his only child with his wife, Latricia, adding that, despite a jury\u2019s convicting him of child endangering, Darst continues to maintain he did not cause injuries to his son, Logan, that included a subdural hematoma (bruising of the brain) and chest injuries. Gordon urged the judge to grant community control in the case.<\/p>\n<p>Darst also spoke prior to sentencing. \u201cSir, I have three other dependent children that depend on my child support checks,\u201d he said. \u201cI just ask for leniency, please.\u201d<\/p>\n<p>The city man was tried twice on the charges, with the first trial in March ending in a hung jury. Assistant Prosecutor Eva Yarger made the decision to retry Darst and that trial, which ended June 2, resulted in a guilty verdict.<\/p>\n<p>\u201cI\u2019m glad that the jury came to the right conclusion,\u201d she said of the second verdict. \u201cI think that\u2019s why we trust in the jury system and I think this was the right verdict.\u201d<\/p>\n<p>Yarger said following the June trial that the decision to retry Darst after the first jury deadlocked was easy, because she really felt he was guilty. \u201cI believed he did it, and I felt the child deserved justice,\u201d she noted.<\/p>\n<p>Those testifying in the case included family members, Van Wert Detective Sergeant Jeff Blackmore, Deb Booth of the Van Wert County Children\u2019s Services Department and Dayton Children\u2019s Hospital physicians Dr. Laurence Kleiner and Dr. Lori Vavul-Roediger.<\/p>\n<p>Darst testified at both trials, as did his wife, who also maintained her husband\u2019s innocence.<\/p>\n<p>Logan Darst was placed in foster care in April 2010 after his injuries were discovered, but died of cancer January 21 of this year.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>DAVE MOSIER\/independent editor A Van Wert man convicted of seriously injuring his 9-week-old son was given a two-year prison term during a hearing Thursday in Van Wert County Common Pleas Court.
