{"id":161019,"date":"2022-12-13T04:42:24","date_gmt":"2022-12-13T09:42:24","guid":{"rendered":"https:\/\/thevwindependent.com\/news\/?p=161019"},"modified":"2022-12-13T04:46:50","modified_gmt":"2022-12-13T09:46:50","slug":"city-council-declines-rv-ordinances","status":"publish","type":"post","link":"https:\/\/thevwindependent.com\/news\/2022\/12\/13\/city-council-declines-rv-ordinances\/","title":{"rendered":"City Council declines RV ordinances"},"content":{"rendered":"\n<p><strong>SCOTT TRUXELL\/<\/strong><em>independent editor<\/em><\/p>\n\n\n\n<p>Discussion of a law regarding recreational vehicles parked on private property inside the Van Wert city limits turned out to be a rather short one Monday night.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignleft size-full\"><img decoding=\"async\" width=\"200\" height=\"231\" src=\"https:\/\/thevwindependent.com\/news\/wp-content\/uploads\/2022\/12\/John-Hatcher-12-12-2022-e1670898636476.jpg\" alt=\"\" class=\"wp-image-161020\"\/><figcaption>John Hatcher<\/figcaption><\/figure><\/div>\n\n\n\n<p>At the request of the administration, Law Director John Hatcher prepared a written legal opinion on the city potentially restricting the parking of RVs in residential areas. In it, he said the simple answer is yes, the city can have ordinances restricting the parking of recreational vehicles in residential areas, with a caveat.<\/p>\n\n\n\n<p>\u201cIt (would have to be) for the health, safety, morals and general welfare of the citizens of Van Wert,\u201d Hatcher told city council members. \u201cAny ordinance passed by the city for purely aesthetic reasons and no other reason whatsoever would not be constitutional and would not be enforceable.\u201d<\/p>\n\n\n\n<p>\u201cThese ordinances are also what\u2019s called \u2018strictly construed\u2019 \u2013 that means if you were to hypothetically prepare an ordinance, it would have to be very specific on what you are restricting and how you are restricting it,\u201d he continued. \u201cAny sort of gray area or anything unclear would be held against the city.&#8221;<\/p>\n\n\n\n<p>Hatcher also said the city currently has no ordinances that restrict the outside storage of recreational vehicles in residential areas other than RVs can\u2019t be parked in a yard.<\/p>\n\n\n\n<p>After a brief discussion and questions by a handful of citizens in attendance, council members brought the matter to a close by stating they had no desire to enact any sort of law regarding the parking of RVs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>SCOTT TRUXELL\/independent editor Discussion of a law regarding recreational vehicles parked on private property inside the Van Wert city limits turned out to be a rather short one Monday night.
