{"id":99746,"date":"2018-03-12T07:43:04","date_gmt":"2018-03-12T12:43:04","guid":{"rendered":"https:\/\/www.thevwindependent.com\/news\/?p=99746"},"modified":"2018-03-12T07:43:31","modified_gmt":"2018-03-12T12:43:31","slug":"ohio-a-g-rejects-short-term-loan-petition","status":"publish","type":"post","link":"https:\/\/thevwindependent.com\/news\/2018\/03\/12\/ohio-a-g-rejects-short-term-loan-petition\/","title":{"rendered":"Ohio A-G rejects short-term loan petition"},"content":{"rendered":"<p><em>Submitted information<\/em><\/p>\n<p>COLUMBUS &#8212; The Ohio Attorney General&#8217;s Office has rejected a petition for a proposed amendment to the Ohio Constitution that would establish new regulations for short-term loans.<\/p>\n<figure id=\"attachment_50826\" aria-describedby=\"caption-attachment-50826\" style=\"width: 150px\" class=\"wp-caption alignright\"><img decoding=\"async\" class=\"wp-image-50826\" src=\"https:\/\/www.thevwindependent.com\/news\/wp-content\/uploads\/2014\/04\/Mike-DeWine-headshot-4-2014.jpg\" alt=\"\" width=\"150\" height=\"222\" \/><figcaption id=\"caption-attachment-50826\" class=\"wp-caption-text\"><strong>Mike DeWine<\/strong><\/figcaption><\/figure>\n<p>On February 28, the Ohio Attorney General\u2019s Office received a written petition\u00a0to amend the Ohio Constitution, entitled the &#8220;Short-Term Loan Consumer Protection Amendment,&#8221; from the attorney representing the petitioning\u00a0committee.<\/p>\n<p>The summary was rejected for several reasons, including:<\/p>\n<ul>\n<li>The summary language stating \u201ccontracts for short term loans cannot be for a longer time period than the original loan amount\u2026\u201d conflicts with amendment language stating \u201cthe minimum duration of a short-term loan shall be the number of months equal to the sum of the originally contracted loan amount.\u201d<\/li>\n<li>The summary language regarding loans exempted from the definition of &#8220;short-term loans&#8221; conflicts with the amendment language exemptions.<\/li>\n<li>The summary language regarding a notice on electronic funds authorization revocations does not exist in the amendment language, referring instead only to contract provisions.<\/li>\n<li>The summary does not reflect the proposed amendment\u2019s provision that the \u201cGeneral Assembly may, but is not required to, enact legislation to license persons to make short-term loans.\u201d<\/li>\n<li>The summary fails to mention that Section (C)(4) of the proposed amendment requires a licensee to \u201cmake a reasonable attempt to verify the borrower\u2019s income prior to initiating the loan.\u201d<\/li>\n<li>The summary omits amendment language stating the amendment would take effect 365 days after it is approved by voters.<\/li>\n<\/ul>\n<p><!--more-->\u201cFor these reasons, I am unable to certify the summary as a fair and truthful statement of the proposed amendment,\u201d Ohio Attorney General Mike DeWine stated in his letter rejecting the petition. \u201cHowever, I must caution that this letter is not intended to represent an exhaustive list of all defects in the submitted summary.\u201d<\/p>\n<p>In order for a constitutional amendment to proceed, an initial petition containing summary language of the amendment and 1,000 signatures from Ohio registered voters must be submitted to the Ohio Attorney General. Once the summary language and initial signatures are certified, the Ohio Ballot Board would determine if the amendment contains a single issue or multiple issues. The petitioners must then collect signatures for each issue from registered voters in each of 44 of Ohio\u2019s 88 counties, equal to 5 percent of the total vote cast in the county for the office of governor at the last gubernatorial election.
